Room inspections in reception: protecting privacy through a clear procedure

The Regeling opvang ontheemden Oekraïne (RooO, Reception Regulations for Displaced Persons from Ukraine) permits staff access to living quarters only under specified conditions. National Ombudsman findings support a predictable and proportionate procedure.

In brief

Ask the municipality for a written protocol covering purpose and grounds, authorised staff, notice, resident presence, the record made after entry and the complaint route. Emergency-safety exceptions should be clearly separated from routine checks.

1. Identify the legal ground

Article 6(3)(d) RooO provides for access where there is reasonable suspicion of a house-rule breach or where entry is reasonably necessary for reception management. It is not unlimited access at any time. Ask the municipality to state the purpose, ground and responsible role.

2. Separate routine checks from emergencies

In publication 2026/052, the National Ombudsman recommended assessing necessity in advance, giving prior notice and inspecting in the resident’s presence. This is not a court judgment, but it is an important standard for proper municipal conduct.

  • verifiable notice stating date, time window and purpose
  • an opportunity to attend or agree another time when there is no urgency
  • a separate route for fire, water leaks, danger to life or another acute risk
  • a concise outcome record without unnecessary personal data

3. Propose one site-wide protocol

The municipality establishes house rules for each reception location. Residents’ representatives can request uniform access rules, clear exceptions and a safe complaint channel.

  • grounds, frequency and notice method
  • key use and logging entry when a resident is absent
  • no photographs of documents or belongings without a specific necessity and legal basis
  • municipal complaint-coordinator contact and response period

4. Record an incident without spreading private data

Record the date, time, people present, stated purpose, notice and actions in the room. Ask the municipality to state the ground and provide the inspection record. A complaint concerns conduct; a formal individual decision or sanction requires a separate objection or appeal deadline check.

FAQ

Is entry prohibited whenever the resident is absent?+

The RooO does not state an absolute general prohibition. The Ombudsman recommends necessity assessment, prior notice and resident presence. The purpose, urgency, rules and facts remain decisive.

Can an external operator set its own entry rules?+

Daily management may be outsourced, but the municipality is responsible for reception and establishes the house rules. Request the protocol from the municipality as well.
